Legal Question in Criminal Law in New York

Hotel robbery

My hotel room in Orlando was robbed due to negligence on the part of the hotel, which they admitted to. They initally agreed to compensate me, however upon my return to New York they completely changed their story. Attorneys in NY are a bit reluctant to take this on, because it is a multi state issue, and having spoken to about 4 attorneys they mentiond that this is the reason that the hotel is taking such action. What other recourse do I have in this matter. any advise would be helpful.

Contact your home/apt/auto carrier to see if you're covered for the loss. If not contact the credit card company used to pay for thee room and dispute the charge. With regard to asserting a clain, if it is a large chain you might get venue here in NY. If it's not, then you'll have to weigh the cost of a lawyer to collect the loss.

It kind of depends on the value of your claim. If it is of a certain value you can fight the case as a diversity or jurisdiction claim in Federal court. IF it doesn't hit the threshold, then you will have to prove venue in NY. I beleive Mr Spector is correct when he says a hotel chain that has residences in NY will likely allow you to sue them here. ON the other hand, you might get more attorney interest if the loss is large or you tell them you are willing to pay part of the bill.

overall, the multi jurisdctional aspect of this case should not be a major issue - there are quite a few ways around this... one being that you could file a federal action, depending on the amount in question, another would be to file in the state where the action occured... there may also be several other options depending on the set of facts...
