Legal Question in Criminal Law in New York
My husband was convicted in a criminal case and has to pay a hefty restitution. There is a life insurance policy on him that we had in place prior to any of his worng-doings that my daughter and I are beneficiaries of. In the event of his death, can the proceeds from this policy be taken for restitution as part of his estate?

This is really an estate question and as a criminal lawyer I am not qualified to answer that question, but I believe that since the proceeds of the insurance policy do not pass through his estate, they are not subject to any claim for restitution, but consult an estate lawyer to be sure.
