Legal Question in Criminal Law in New York
My husband is currently incarcerated in a new york state prison on a 2 year sentence. He is now being charged with 2 felonies and 3 misdomeanors from a seperate incident, the city we live in is trying to wait until his time is up and re-arrest him on the new charges. The charges were from December 30,2010 and when he plead to the current charges he plead guilty to all known and unknown charges, his sentencing was on January 10,2011 do these charges roll into that plea? and if not what can i do ?

If the plea minutes actually show that the plea covered all known and unknown charges and there were no false representations on the part of your husband, new state charges would be barred.
