Identical Twins

Can either identical twin be charged with murder? Considering identical twins have the same DNA.

NO. DNA evidence is just one piece of evidence necessary to prove a case against an individual... there is also testimonial evidence which could rather easily show reasonable doubt. All that is necessary to defend such a case would be some doubt, sufficient to make a reasonable person doubt the facts ofthe case, in the facts you described this doubt would have to be inherent...

The state must prove their case beyond a reasonable doubt. If the state can not prove who committed a crime, that is doubt and a conviction will not hold. So the answer is no they can not.
