Legal Question in Criminal Law in New York

illegal drugs

my mom recently let her grandaughter move in while she gets back on her feet. my mom thinks her grandaughter is selling drugs. she isn't 100% sure but there is prior arrest for dealing drugs. how can i get her out of the house without affecting my mom. if the pd gets involved my mom is afraid she will be in trouble also for letting her live there. my mom is eldery and disabled and scared. thank you

First question, is hse living in public housing? If she is this alone is cause for eviction bby the housing authority under Rucker v. HUD.

Otherwise, if the police happen to search the place as result of some independent grounds and drugs are found in the premises there may be a presumption that your mother knew.

The only way to get her out of the house would be through speaking to your mother and asking her to ask her to leave. Otherewise a call to the police department may not yield exactly the same results you would want... however it may be a consideration.

This may be an answer/question that depends on your location. Looking at your zip code, it appears you live in a small, predominantly middle class community with approximately 1/3 of the population renting. A local criminal and/or landlord-tenant attorney would probably be able to offer you an accurate answer as opposed to an educated guess.
