Legal Question in Criminal Law in New York

Illegal Irish Immigrant testifying in Criminal Trial

Illegal Irish Immigrant is subpoena'd to testify on behalf of a victim in a criminal case. Are they in danger of being deported if they show up and testify? It's a People vs. XXXX case. The victim does not want to get their friend in trouble or deported or in the system to be deported in the future. Any help?

Re: Illegal Irish Immigrant testifying in Criminal Trial

Generally the answer to your question is no. The issue of your

Citizenship status shouldn't even come up at all. In many cases even

The accused may not face any negative immigration

Ramifications.

If you want to testify I wouldn't worry about this much at

All. You must also know that you are not forced ti testify

Either, you can simply chose not to or if you do and there are

Any questions of your citizenship you cam always opt not

Ti answer those questions.

However I can assure you that there should be no negative

Immigration ramifications unless there is an admission to

A crime on your part on the court record
