Immigration and Federal Conspiracies
My fathers has been charged with a federal conspiracy with the intent to distribute. He was born in Guatemala the judge requested he stay in the USA does that mean that he will NOT be deported?

Based on what you have written, it is not fully clear what the judge has requested. The judiciary and immigration are two completely different branches within the overall government. Additionally, the judge may have specific justifications for requesting your father to remain in the U.S. You should seek information from your father's attorney. It is common for judges presiding over criminal cases to restrict a defendant's travel for fear that the defendant will flee to avoid prosecution. That is likely the judge's concern regarding your father, particularly if he is not a United States citizen. If your father is not a citizen, he may face problems with Homeland Security regardless of the crimnal accusation. Of course, if he is convicted of the conspiracy, his problems will multiply rapidly. It is essential that your father have a good lawyer to protect his interests.
