if a person has not been indited and waved their 188 or 180 what ever its called how come they havent been released?

The 180.80 day is the day six days after arraignment on the complaint in criminal court for incarcerated felony defendants on which the DA must either procure an indictment from the Grand Jury or release the defendant from custody. 180.80 can be waived, and it sounds like that is what happened in this case. That is why he has not been ROR'd after the grand jury did not return an indictment on the 180.80 day.

Released without bail, if you've waived it then it
