Help for an innocent man

My fiance was accused and arrested of being involved in a shooting in Harlem. The problem: He is innocent! He went to dinner and then went to the movies. He was appointed a legal aid attorney but the attorney has not requested subpoenas for the video tapes from the businesses that could verify that he was not in the area during the time the shooting occured. I fear that the businesses will delete the footage from the date in question and there will be no other way to prove his innocence. My question: In a criminal case, can I get a subpoena as an individual or can it only be obtained by an attorney or court officer? Please help, I am at wits end trying to prove his innocence!

You should be able to have the video surveillance tapes preserved by writing to the businesses and requesting it. You should also visit the businesses in person and request the tapes be preserved, giving them the date and time you need.
