Legal Question in Criminal Law in New York

internet death threat

is it a crime to threaten to kill someone in a myspace comment. In case you are not too myspace savvy, comments are open to a limited amount of public view. Could this result in trouble for the commenter??

In NY, there is a crime that can apply to this. It's called Aggravated Harassment (and I think it's the 2nd degree). I had a client charged with this over a "threat" that was much more vague. We were able to get that case dismissed. Your case sounds different, but if you are in another state that may help. --Warren

In Minnesota, a prosecutor might charge "terroristic threats," "harassment," or various other crimes.

It would depend upon all of the facts and circumstances, however. In addition, not every accusation results in a conviction, nor should it.
