Legal Question in Criminal Law in New York

Jail time

I am facing a sentecing on 12/20. I took a plea bargain in my case. It is now considerted a misdeamnor with possible 1 year jail time. Aslo resitution and so forth. I am not guuilty of this but took a plea bargain. My lawyer the public defender said this was better than facing a felony charge. I have no other record or violations. I am a 50 year old woman with a lean record. I am frightened of the thought of jail time. What do you think the odds are of the judge sentencing me to jail time? Thank you.

Re: Jail time

I am sorry this has happened to you in this stage of your life. Assuming you have family in the area, are employed, and have a good record - the possibility of jail time is very small. It is not something for you to lose sleep over.

If you wish to act pro-actively to reduce the probability of jail time, then soliciting letters of recommendation from friends, family, clergymen, other pro, inant citizens. perhaps enroll in an educational program. Give them something on paper to indicate that this will not happen in the future. Good luck in December.
