Legal Question in Criminal Law in New York

law suit

Can I file a law suit against village police for being wrongly accused and arrested of a crime when I had all supporting evidence showing my innocense at the time of the incident? District attorney was involved and also reprimanded police for arresting me before dismissing all charges.

Re: law suit

You may have a case but I would need to speak to you to get more facts. Generally, the police are immune from a false arrest suit if they are acting on information provided by an identified citizen. However, there are cases that say the police can be liable if they fail to investigate information readily available at the time of arrest that suggests innocence. I handle many false arrest cases so please feel free to contact me. Please be aware that you must file a notice of claim against the police and municipality within 90 days of your arrest to preserve your State law claims. The above is for informational purposes only and not meant as legal advice as there is no attorney-client relationship at this time.
