Legal Question in Criminal Law in New York
Can the law USC 3624 which allows prisoners to get out early for good behavior in prison be denied the prisoner? The Judje was not pleased that the person did not go for treatment for the DWI prior to jail so his option was no early release for good behavior. The person was given a year - The sentencing date was set at the end of the year, so the person would stay in the full year? Prisoners and guards never heard of this. zIs this allowed

The statute allows the BOP full discretion and cannot be overruled by the judge.
