Legal Question in Criminal Law in New York
Do I need a lawyer
I was a school volunteer for 14 years at the same school. I was told by the principal I can no longer volunteer being that a tecaher came to him nad said a girl in the 7th grade said I kissed in her in the mouth.This was said to me @ 1 month ago.I then recieved a letter Thanking me for my volunteer services but I no longer can volunteer at this school.1 monthlater I recieved a call from a dective who wolud like to to interogate me on 6/3/08.I how do proceed from here do I go alone or witha lawyer? I live on a fixed income and I'm male 62 yrs of age. Please help soon. Never had trouble with law, I'm really not sure under what catagory this falls under. you can speak to my wife--name removed--Hernandez

HIRE A LAWYER IMMEDIATELY! in general the police do not have you best interest in mind when wanting to interview, and you want to ensure that your rights are absolutely protected...

You should definitely hire a lawyer before you go see the Detective. It is likely that you are going to be arrested when you go to the police precinct. If you cannot afford a lawyer, try calling the Legal Aid Society, but I'm not sure they handle cases before arraignment in court. If you decide to go to the police precinct alone, its probably best not to answer questions as anything you say can be used against you in court. You certainly should retain an experienced criminal defense attornet before you do anything further. By appearing alone you risk greater liability,inasmuch as anything you say can be used against you in the future. Call the dectective and tell him/her that the interview should be postponed pending your retaining an attorney.
