Legal Question in Criminal Law in New York
Lazy Lawyer
My ex-husband hired a lawyer for his father and paid him 10,000. Now the lawyer is not showing up for court dates, is not returning phone calls, has made no attempt to contact anyone who has information related to this case. The lawyer went to see his father once, what can we do about this?

I would file a complaint with the Bar Association

Contact a new lawyer and request the old attorney to provide a statement of work done as well as a photo copy of the file.

You should first advise the lawyer in writing (immediately) that unless he or she begins performing all of the services you listed in your letter AND properly, zealously representing that client, you will report him/her to the Grievance Committee.
Next, if you don't get immediate and satisfactory results, (1) report the lawyer's conduct to the State Grievance Committee and (2) demand a full refund of the legal fee.

The best and simplest thing to do is to contact a new attorney and have that attorney contact the previous attorney to turn over the file, a breakdown of expenses, as well as any money left over in your account.
