Legal Question in Criminal Law in New York

legal question

in ny state if three indvidual defendents are charged with the same crimes (fraud) in the same case...can the same attorney represent the individuals or does a conflict of interest exist?

There is conflict in most cases. Each defendant should be represented by an attorney.

You should have diffrent attorneys, generally the Court does not look positively on attorneys handling multiple defendants past the point of arriagnments.

However, you can spea to one attorney and have them find atotrneys to defend the others... or simply contact individual attorneys.

multiple defendants can be represented by one attorney if they all making an informed decision to do so. it would be rare that three have the same attorney, but i've seen two have the same attorney. depends on the case. if the two defendants have given statements that will be introduced at trial, their defenses will usually diverge and separate counsel will be necessary. so to answer your question: in theory yes, in reality no.
