Legal Question in Criminal Law in New York

Can I be legally charged with anything if I was unknowingly solicited by a minor on craigslist? I was looking for a date with an adult woman. But instead a minor answered my ad. And when I met her at her home, her mother told me she would call the police. But didn't. She took all of my info and now threatens me with legal action if I don't pay her money in restitution. This was 2 weeks ago.

The law does not (usually) charge for conduct which is unknowing unless reckless or negligent. There are some crimes however, which are strict liability --meaning you did not have to know the circumstances of your conduct. With that being said, your case would be very fact specific. Did she answer an ad and pose as an older woman? Did you find out she was younger? what was the content of the emails back and forth?

Restitution is the making good for a loss incurred by a party. Your case does not sound like restitution. It sounds like a form of a " shakedown". I would keep a record of all conversations with these people.

I agree with the previous answer. The specific facts in your case will determine criminality or not. I would retain a competent criminal defense attorney to assist in the analysis.
