Legal Question in Criminal Law in New York
I Live in NYS and am charged with 3 class A misdemeanors a class D felony and 2 class E felonies does Article 30.30 apply to me on the misdemeanor charges if there is felonies involved or is it restricted because I am charged with felonies along with the misdemeanors? Also is it 90 days they have to prepare for trial since the initial arrest date or do I have to say on record in court I am ready for trial and it is 90 days from there? Thanks.

The speedy trial rules apply to the top count only and they run from when the accusatory instrument is filed. You have no obligation to announce ready.
