Legal Question in Criminal Law in New York

I made arrangements for rent a center to come and pick up Bedroom furniture which they never picked up. We got evicted and the landlord threw out the furniture. I understand that I am responsible for the payments and that it can an will negatively affect my credit but can they file theft charges? Obviously if I didn't have the money to pay for rent then I couldn't pay them the payments which is only about 199.00 behind. I am currently seeking new employment and want to make some sort of payments but they are saying give them 199 by the end of the month or charges can be filed...and my combined checks for the next two weeks will

not equal to $199.00.are they legally allowed to do this?

This should be a contract dispute and collection actions should be the remedy but I can not state that criminal charges can not be brought in a situation such as this. Many companies and District's Attorney offices are bringing these things to criminal court instead of civil court or in addition too. You should consider talking to a criminal attorney in your area. Call the local bar association for a name for a pro bono attorney to at least get a free or low cost consultation. You need an attorney who can advise you on the local situation.

I do not see any criminal responsibility on your part. The furniture was lost because of their neglect.
