Penelope is a 16 yr old who drove past her time restriction one night. Britney passes a red a light an hits penelope's car. The car Britney was driving was stolen from a dealership who left the keys in the car. The passenger in penelope's car was not wearing a seatbelt and was injured. Can the passenger bring negligence claims against Penelope, Britney and The dealer for damages?

If there was negligence in the car dealership leaving the keys in the car, then an action can be brought against the dealership.

Penelope did not cause the accident, and driving past her time restriction was not a contributing cause of the accident and she has no liability.

Britney has liability because she caused the accident.

Therefore, an action should be brought against the car dealership and Britney,

This should be done right away, so an investigator can be employed to nail down the facts for a possible trial in the future.
