what's the minimum sentence in new york state for a first time offence of these crimes combined; RESIST ARREST, CRIM POS WEAP-4, CPCS-7, CRIM POS WEAP-3, CPCS-3, CPCS-3
1 Answer from Attorneys
For the first time offender, the mandatory minimum period of incarceration would be at least one year for the CPCS3. For the Criminal Possession of a Weapon in the 3rd Degree one can expect a term of incarceration of one year. The CPW3 holds a mandatory minimum sentence of one year, although the Court can set aside the the one year sentence. The misdemeanors each have a maximum sentence of one year. Depending upon the circumstances of the case the sentences could be served concurrently (at the same time) or consecutively (one after another).
