miranda rights underage drinking
my son was arrested/handcuffed behind his back/not read his miranda rights/asked for $100 bail and wrote him a ticket for an open alcohol container and is only 17 years old. should i have been notified. they kept him in custody for 6 hours

Re: miranda rights underage drinking
You do not get Miranda rights unless you are questioned while in custody. The police are not required to notify you especially when they are not holding the defendant and are releasing him on station house bail or on a Desk Appearence Ticket(a DAT)
