Even most second offenders can have their cases reduced for plea bargaining reasons. So in short answer, it is very possible the DA may reduce your charge, but he doesn't have to. DA's are under no obligation to reduce a charge or plea bargain it down. To enhance your chances of getting a favorable disposition of your case you should retain a lawyer or if you cannnot afford one, ask that the court assign you a lawyer. Criminal charges, even minor ones really require a qualified lawyers involvement to assure the best result.

99.9% get reduced, especially for first time offenders. You may not need a lawyer to get a reduction, but a lawyer could increase the amount of the reduction.
