Misdemeanor Cases

How long can a misdemeanor trial typically last? Also, if my case goes to trial, am I in front of a judge or a jury?

A misdemeanor jury trial in New York can last anywhere from two days to two weeks. If the case goes to trial outside the city of New York you are entitled to a jury trial. In New York City, the prosecutor has the discretion to reduce the charges to a class "B" misdemeanor and thereby avoid a jury trial. You can always request that the case be heard by only a judge, without a jury but usually that is not advisable.

Any trial takes as long as is necessary

for all the witnesses to testify and

evidence to be presented. This can be

two days or two weeks, or two months.

All Class A misdemeanors entitle one to a jury

trial. All Class B misdemeanors can also have jury

trials except in NYC.
