Legal Question in Criminal Law in New York

Molesting

I have a good friend who is now 32, and his sister is now almost 27. The sister is now trying to accuse him of molesting her when she was 12. It is not true, I know the man and he is definately not the type to do that. At the time he would have been 20 and out of the house. Since it has been so long since it happened, is there anything that she can do about it? Or have her statutes of limitations run out? Can he sue her for slander? Thank You.

Re: Molesting

This is a disturbing story. While I trust your evaluation that your friend would never perform such a deed, her statement indicates that it is very likely that she was molested.

Often people accuse a 'safe' target rather than the actual villain. It is important that your friend act with compassion and love. While communication with her now may not be possible, please ask him to keep his heart open to his troubled sister who will need his forgiveness and help in the future.

When she is able to articulate who the real criminal is, then she will be open to him again.

Yes, slander is a possible cause of action in this case.
