Legal Question in Criminal Law in New York

How many months do you have until you indicted after you are arrested, and bail out for a felony? In regards to the DA requesting for you to come in and take DEA in regards to the case, should you volunteer or have them motion you to come in. Also can they make you come in before your next court date case been pending since Dec.

Your questions have numerous answers.

First, depending on the situation, indictment must occur within 180 days from arraignment but can be put off if defendant waives or other situations occur in which the court extends the time.

Second, I am not sure what a DEA is but I can surmise that it it either a polygraph or in some cases a debrief in exchange for a plea bargain, either way it is voluntary and can not be forced. If it means something else you can e-mail me and I will answer that question subsequently.

Third, yes under certain circumstances the court can make you appear earlier than the date stated at your last appearance.
