Legal Question in Criminal Law in New York
murder
I have lived with this guy for 4yrs been standing by his side for almost a yr or less while he has been convicted for murder that had happen over 30yrs ago. I beleive he is inocent and will still stand by his side. my question is as followed he went for trial and it turned out a misstrial. Will be going for another trial Feb of 08 the jury was more to his favor 1st being 6/6 2nd 10/2 & 3rd 7/5 why is it that this is a mistrial the family has an appointed lawyer and I am afraid that this lawyer may not be doing his job I really hope that he is not being railroaded sort of speaking. The husband to the victem that had gotten murdered in 1974 more or less admitted he might have done it on the witness stand. What is wrong with this could you please get in touch and let me know what I should do in this case. Thank you Barbara

A mistrial can be called by the judge when the jurors cannot reach a verdict (though the judge can also simply instruct them to keep trying to get a unanimous verdict, after a point he/she will call a mistrial if they can't agree).
It appears you may need to look for another attorney if you and the accused don't have confidence in the lawyer.
