Legal Question in Criminal Law in New York

MYstepson is not a rapist this is a unual case and something smell about it.

my son was follwing his friend and made one of lifes biggest mistakes and got sentence for 6 month and sex offender for 10 years "death sentence",his lawyer told us that he would get the same sentence that his friend did,well for some strange reason they did'nt want him to talk to his so call friend and no contact,well we dad and mom found out his friend did'nt have to be on the sex offender list. The lawyer told us that he would'nt get top level sex offender,he did life has been destroyed for this young man I known him since he was 15 never has he ever done anything like this he was 29 when this happen the girl was 16 of course she lied to the boys. Her statement to the she told them to come over she was friend of the other man, she told the police she told them where she lived, she took the boys to her room ,she told them what she wanted done to her if he was a sex offender i would be the first one to tell them to throw him in jail and throw away the key, i have two girls of my own and his sister is 15 so we that know him know he's not. please can u help.

You don't mention whether the sentence was pursuant to a plea or trial. There may be an appeal available to you or a motion to vacate the sentence. Also, depending on his sex offender registration level, he may be able to challenge that rating or apply for a downward departure, to a lower registration level, based on the statute.
