What is needed to be proven for a case that is given a hearing to dismiss in the interest of justice?

Generallynits atbthe judges discretion but you wouod have to show the person isn't a danger to commit more crimes, that the punishment would not fit the crime... And that there may be no need for further punishment... If done so well the judge may dismiss after a Clayton motion
