Legal Question in Criminal Law in New York
NYC voyeur crime
I have been arrested once in 2005 for video taping under skirts. I did not spend jail time for that. I was caught this past may and I was in court today . I have to go back in sept for some Grand Jury thing. My lawyer suggests I go into some program to avoid possible jail time. I have no other criminal record besides this. Do you think theres anyway I can stay out of jail? Thank you.

It is possible you may be facing felony charges or the District Attorney's Office may reduce the charges to a misdemeanor. I have worked for the Brooklyn District Attorney's office for a number of years and now work as a defense attorney. A good criminal defense attorney may be able to negotiate a deal where you can avoid jail time, although it will depend on a number of factors. Please feel free to contact my office if we may be of any assistance in this matter.

The appearance next time in court signifies your case is being treated as a felony, which jail time could be one punishment for - there may be a multitude of ways to avoid jail time in this type of situation.
