NYC voyeur crime

I have been arrested once in 2005 for video taping under skirts. I did not spend jail time for that. I was caught this past may and I was in court today . I have to go back in sept for some Grand Jury thing. My lawyer suggests I go into some program to avoid possible jail time. I have no other criminal record besides this. Do you think theres anyway I can stay out of jail? Thank you.

It is possible you may be facing felony charges or the District Attorney's Office may reduce the charges to a misdemeanor. I have worked for the Brooklyn District Attorney's office for a number of years and now work as a defense attorney. A good criminal defense attorney may be able to negotiate a deal where you can avoid jail time, although it will depend on a number of factors. The appearance next time in court signifies your case is being treated as a felony, which jail time could be one punishment for - there may be a multitude of ways to avoid jail time in this type of situation.
