Legal Question in Criminal Law in New York
Obstructing Governental Administration
A guy beat my friend with a crowbar in my front yard. I was not home when this occurred. When I arrivved home, I found him close to death down the street in the bushes. I called 911. The ambulance came and meanwhile officers were on the street in front of my house and in the yard. The person whom beat him had not been apprehended yet. My ex-husband pulled his car in front of the house next door, got out and walked into my yard. He was at six yards onto the property when an officer told him, ''Stop, this is a crime scene.'' Instead of stopping he turned around and headed off of the property. At that point he was arrested for OBA. My question is, should not have the property been secured by some sort of apolice line to ward off such a thing from happening? He was handcuffed and the officer pushed the side of his face onto the hood of the police car. Was not this a little unnecessary? Do they really have a case consisdering if they had been doing their jobs correctly, he woulkkd not have been able to even access the property, specially since the suspect was still at large? My ex-husband has no previous record. Is there a way to have this dismissed without having to hire an attorney?
