Legal Question in Criminal Law in New York

do i have an option

I was giving probation for a crime that demanded one year. I did two months in jail and was released on probation and sent to an out paition program. I failed to atten the program with lead to violating my probation. now when i go in the judge will probly take my probation away and put me in jail. my Q is. is there a way the the court could put me in a inpaition program, (considering it was the reason why i fail in the first place) instead of putting me in jail. is there a legal procces for that?.

Yes you do. The probation officer has to violate your probation and you will appear before the judge for resentencing.

I would strongly suggest that you hire a good lawyer and voluntarily place yourself in an inpatient program. Your probation officer can recommend one.

When you appear before the judge, he/she will see that you are trying to rehabilitate yourself. You must be proactive. It will pay off in the end.

You should communicate these needs to your attorney, if you do not have n attorney then you should consider hiring one.

It very well may be possible to get you into an inpatient program... however, you are correct and the violation of probation could potentially have you locked up, not necessarily however...
