Legal Question in Criminal Law in New York
I have an order of protection barring me from my home. The individual has lied about my whereabouts in a police report, causing me to miss a court date where I was going to show incriminating evidence against this individual. Can this case be thrown out on the basis of contempt of court?

The court will not hear your evidence until a hearing or trial is conducted. In this case, the person who has the order of protection in their favor is not going to be found in contempt. You need to bring this matter to a trial to determine the validity of the claims made against you. Do not try this matter yourself. You need dispassionate counsel to assist you.
