Legal Question in Criminal Law in New York
I have an order of protection against my ex-boyfriend in april 2009. He wasn't physically abusing me we just argued alot at that time & it was more mental. Now I have a change of heart we've been talking alot lately. He hasn't moved back in my home. He doesn't want to get back with me because he's afraid to get locked up. Can I stop the order without getting in trouble.

A judge is the only one who can rescind the order. You must appear before a judge ( usually the one who issued the order and ask for it to be modified or taken away) There is no penalty and you should not get in any trouble for making the request. It is up to the Judge, however, to decide what to do.
