It depends on the jurisdiction. CPCS VIII is a class "A" misdemeanor. In busy jurisdictions like Brooklyn and Manhattan the prosecution will offer a "Violation" a non-criminal offense. Other jurisdiction may want a plea to a misdemeanor with a fine or probation. Usually first offenders are not sent to jail.

I agree for first offenders there will likely be NO JAIL. However it is equally important to assure the first time offender that there will be no serious future consequences such as a criminal record. I handle these matters on a daily basis ,so please contact my office @ 7188340087 for a free phone consultation.
You should not expect jail time, but it would be highly recommended to have an experienced lawyer with you defending you and preserving your rights in court. It would also greatly increase the chance of lowering the charges or possible dismissal. We have substantial experience handling these types of cases and reasonable fees, however, we would need some more information before making a complete and proper determination.
