CPCS (220.16)in the 3rd degree is a felony. Under 70.06, if you are convicted of a second non-violent felony within ten years, the court must sentence you to a mandatory indeterminate prison sentence.
So what happens will depend on what the previous conviction was for, what the drug in the current charge is (heroin treated more seriously than other substances) and most importantly what the outcome of your current case.
If you'd like to discuss this charge and representation costs, you may contact my office via email.

You had better try to get into a drug treatment program as soon as possible.
