Legal Question in Criminal Law in New York
If a person was arrested 3days after detectives find a firearm and is currently incarcerated and has served 7 months jail time in a NYCDOC facility and there is no evidence or DNA proving the inmate had possession of the weapon how long can the city hold them ?

It sounds as though he is in jail while he awaits trial because he hasn't posted bail. If his legal aid attorney isn't returning your calls, you might want to hire a private attorney.
The constitutional right to a speedy trial is somewhat slower in New York than the framers of the US constitution intended!
