Legal Question in Criminal Law in New York

Personal assault

I was recently assaulted in N.Y.

state and received multiple facial

fractures,requiring reconsructive

surgery. The person who commited

the crime was charged with 2nd

degree assault. He is also 20 years

of age. Do I have any legal

recourse, or the ability to file suit

against this person, or his parents?

Re: Personal assault

I am working on a case very similar. You can sue but the real issue is whether you can collect? Does the person have assets or a job? It may be better to let the criminal course run its course to see if he pleads guilty which would help a civil case; there is a one year statute of limitations though. Feel free to contact me. The above is for informational purposes only and not meant as legal advice.

Re: Personal assault

You can sue the 20 year old individual inasmuch as he/she is an adult.Unless the parents had a direct connection to the incident they are not civilly responsible. You may contact my office @ 7188340087 to discuss no up front cost of representation in this type of case.
