Legal Question in Criminal Law in New York
I sent a personal check for a retainer to my son's attorney as a possible warrant for arrest might have been issued. The attorney mad a call and sent 2 faxes. Can I get the balance of the funds back directly to me

That would depend on the retainer agreement that you signed. If the retainer agreement indicated that the fee was a non-refundable flat fee, then you're probably not going to have much luck, but if the fee was hourly and you don't believe the attorney fully exhausted the retainer (because of the lack of work), then by all means, request to see the invoice and ask for a refund.
Be aware that the attorney may bill you for the time he spent discussing the case with you in addition to the above.
