Legal Question in Criminal Law in New York
if two persons are drinking and without a reason one punch the other one and kick hin . and this one ends in the hospital with broken ribs . what can i do now?

Two things you can do: Press criminal charges. File a civil suit for assault & battery.
You can report it to the police - they may or may not arrest the person. You can also sue the person for pain and suffering and any unpaid medical expenses and lost wages. Whether it makes sense to sue depends on whether you can collect from the person. Assuming you are the one who ended up in the hospital, you can sue him in civil court for damages, have him arrested or both.
