The criminal court is not where you want to first seek out drug programs. Nor will addiction work as a defense. The drug court alternative is a risky proposition for the majority of addicts (assuming the person qualifies). Retain a knowledgeable attorney and explore all options.

There are programs available through the courts to get help for drug addiction. You shouldn't however really on them. IF you want help asking the courts for a referral that you will follow up on yourself is a good way to start. You can also call up 311 (in NYC) or your county drug addiction hotline and they can refer to city/county and other agencies that may help.

Of course if you can afford a lawyer, and he is a criminal lawyer that person can be the best resource for referral to drug and alcohol rehabilitation.

Good Luck.
