Legal Question in Criminal Law in New York

petit larceny

my daughter was charged with petit larceny in new york state. She went to court for this and made arrangements to make restitution. She failed to do so, thus was arrested again. She has a 6 mo. old infant now, and a job and has tried to straighten out her life, except for not following through with this issue. She will go to court again. What will happen? Can I, on her behalf, make arrangements for restitution? If payment is made, will she still be sentenced? and what is the possible sentence. She has had brushes with the law before, but never did any jail time, except for this time.

I cannot say what will happen the next time she goes to court. A court however will be very happy to see that someone made the victim whole. Further, if you and she are willing to work together, the court may also be impressed that a family member has seen an improvement and is willing to provide support for her.

Get her a quality defense lawyer. One who is as sharp on trial as he is on sentencing issues. The combination will push the court as well.
