Petit Larceny in NY

Hello, I was arrested yesterday for Petit Larceny (Shoplifting) at a store. The police released me with an appearance ticket and no bail. I am 32 and have no criminal record or tickets. Dont know why I did it. I dont want to go to jail. I am on a limited income and cant afford $1,000 for a lawyer. What are my options

It seems that with the right lawyer it should not be a problem to work out a deal with the DA to get you what is called an ACD (adjournment contemplating dismissal) and as long as you don't commit any crime over the next 6 mos to a year it would get wiped away....�..however, we would need some more information before making a complete and proper determination. I am sympathetic to you. People often do things on a whim which are not in their own best interest and would not do if they gave it more thought.

In general, the DA is required to give you the same plea-bargain offer with or without a lawyer. That means you do not need a lawyer, but it is always best to have a lawyer to help.

Youe email indicates that you are guilty and have very little defense to the charge. Your goal is to get out of this with as little damage to your life as possible.

The DA may offer a 'conditional discharge' which turns into a dismissal ('ACD') if there are no further incidents within 6 months or one year.

The number one thing you can do to help your negotiating position is: ask for a jury trial. You must do it now. This makes having a trial much more expensive to the government and is an incentive to them to offer a plea bargain.
