Legal Question in Criminal Law in New York

petit larceny

i am from pennsylvania and on probation in new york i was arrested for petit larceny the value was $20.00 the police told me to just plead giulty i will probally only get a fine now my probation officer wants to violate me if i was convicted and sentenced to pay a fine would i still get a fine and what is my deadline on withdrawing a plea

Any conviction for any offense, other than a traffic infraction may be used as a basis for a violation of probation. It is best to withdraw a plea before sentence but you can make the attempt at any time,however the longer you wait the less of a chance of success.

Withdrawal of a Plea is not a matter of

right. Your question sets forth no

legitimate basis for withdrawing a plea.

If you are found to have violated probation, you

can be sentenced to one year in jail, if

the conviction was in New York, but it

sounds as if the conviction was in PA

and I do not know PA law.

You also do not state how you are alleged

to have violated probation. This clearly

affects any decision.
