Legal Question in Criminal Law in New York

petit larceny--psychiatric condition

i got caught shoplifting recently. I have been extremely depressed and am on heavy medication such as prozac and lithium, and I believe this has played a major role in this incident.

would it be possible to get my case dismissed by the DA?

Possible but unlikely. You should contact a criminal defense attorney who has worked with patients such as yourself. He will need to bring a motion to dismiss in the interest of justice. You may also have to hire an expert who can attest to the effect of the drugs and depression on you.

It is not likely,however a competent criminal defense attorney should be able to work out a disposition which might involve counseling and then perhaps an "acd" which means adjournment in contemplation of dismissal. You may contact my office @7188340087 for more information.
