Discarded material is usually open to the taker. You should seek legal help immmediately. A petit larceny is a serious misdemeanor. It will bar you from traveling outside of the USA and could cause the government to revoke your visa if you should be awaiting citizenship, as it is considered a "Crime of Morale Turpitude"
