Legal Question in Criminal Law in New York

petty larceny

I was arrested with my mother for petty larceny the stuff was worth $88.00 and $89.00

where as the store combined the amount to $177.00 instead of filing it seperately

I have been refered to go to stoplift program and I am a nursing student and cannot afford to have a misdemeanor on my record as I will not get my license

will the judge consider that this is my first offense and I need to keep the record clean

will the DA give me a plea bargain that does not give me a record?

please advice

Re: petty larceny

Dear Reader:

In examining this response, please note that we are not entering into an attorney/client relationship, that this is to be taken as informative, and not as legal advice, that it is always best to speak to a lawyer in your area and/or in the area where the transaction and/or events occurred, and that my answer is necessarily limited by the fact that I have not seen the documentation or had an opportunity to go over the matters with you in detail.

Ask your Legal Aid lawyer about making a deal with the DA. Your lawyer is in that courthouse everyday and will be in the best position to tell you what is or is not likely.

As a general proposition, plea deals are made every day, and unless there is more to the story, you would seem to be a candidate for an adjournment in contemplation of dismissal.

Also, it is a bad idea to talk about your criminal case on the Internet; it is like announcing it to the world on a speaker, and what you say could be held against you.

As I mentioned before, this is something that you will want to take up with a lawyer of your own selection, either in your state or area or in a place where some of the pertinent events occurred.
