Legal Question in Criminal Law in New York
Petty Larceny
I was arrested for shoplifting and charged with the lightest petty larceny infraction. I am 16 years old and this is my first offense. My questions are, under New York law what can I be sentenced with? and can my record be erased so it does not handicap me when I apply for jobs, credit, etc.?

If this is your first brush with the law the prosecutor should offer you an ACD which means an Adjournment in Contemplation of Dismissal. Simply put - the case is adjourned for 6 months and if you don't get into any more trouble - dismissed. Some courts will require that you have counsel in order to make this plea since they want you to be sure that you recognize the process through independant counsel. In any event - you get one "get out of jail free" card - once used - the ACD is never available again. Good luck!
