Petty theft first offense
My mother was caught walking out of the store with $30 worth of Salmon. She was arrested and has to appear in court on 04/19/07. She is 54 years old with no prior record of anything. She has a weak health so I can not afford her to do any real time in prison. What do I do and what are the possibilities?

You need to retain an attorney for your mother. Although jail time for a first-time offense such as this is highly unlikely, your mother's health dictates a quick resolution to this matter.

Without a prior record and with legal representation, your mother should have a very good chance of having the charges either substantially reduced (to a violation & fine) or dismissed. She may need an attorney. At the first court appearance, talk to the assistant district attorney and see if they will dismiss the charges as long as your mother attends STOPLIFT or some similar program. If they will, she can get the charges thrown out this way.
